Penalty for workers who fail to comply with certain obligations of the LFT is increased
On April 4, 2024, the Decree amending Section III of Article 994 of the Federal Labor Law (LFT) (the Decree) was published in the Official Gazette of the Federation.
Pursuant to the Decree, the penalty for employers who fail to comply, among others, with the following obligations is increased from 50 to 1,500 Measurement and Update Units (UMA): (i) provide workers with a safe place to store work instruments and supplies; (ii) issue every fifteen days, at the request of the workers, a written statement of the number of days worked and the salary received; (iii) issue to the worker who requests it or leaves the company, within three days, a written statement regarding his/her services; (iv) grant workers the time necessary to exercise their right to vote in the elections; (v) allow workers to miss work to perform an accidental or permanent commission from their union or the State; (vi) make the deductions requested by the unions from the regular union dues; and (ix) affiliate the workplace with the Institute of the National Fund for Workers’ Consumption, so that workers can be subject to the credit provided by said entity.
The Decree is of utmost importance, since the increase in the payment of the above sanction for these breaches goes from $5,428.50 pesos to $162,855 pesos, taking into consideration that the value of the UMA in 2024 is $108.57 pesos.
