The Law to Prevent and Eliminate Discrimination is modified
On December 4, 2023, the addition of section III Bis to article 1 of the Federal Law to Prevent and Eliminate Discrimination (LFPED) (the Amendment), was published in the Federal Official Gazette.
Under the Amendment, 4 sections were established with the types of discrimination that can be incurred in relationships between individuals: (i) Intersectional Discrimination, occurs when one person receives less favorable treatment than another in a similar situation; (ii) Indirect Discrimination, is that which occurs in the public or private sphere, when a provision or criterion apparently implies a disadvantage to people from a specific group; (iii) Structural or Systemic Discrimination, refers to the set of norms, rules, routines or behaviors that cause a situation of inferiority; and (iv) Discrimination by Association, is that which occurs due to the relationship to a person or group of people.
It is important to take into account that this Amendment goes hand in hand with what is established in the Federal Labor Law, on issues of discrimination in labor relations. Derived from the above, discrimination issues continue to be transcendental in relationships between individuals and very specifically in work relationships. Therefore, it is important that we continue training middle managers in companies to avoid falling into this type of behavior.
