On February 3, 2023, the Resolution that modifies the diverse one by which the general provisions for the registration of individuals or companies that provide specialized services or execute specialized works referred to in article 15 of the Federal Labor Law (LFT) (the Amendment).

The Amendment contains modifications related to the Registry of Providers of Specialized Services or Works (the Registry), among which are changes in the causes for which companies can be removed from the Registry for maintaining an employer simulation. With this, it is expected that there will be greater control in compliance with the rules for contracting specialized services and that the Ministry of Labor and Social Welfare (STPS) can carry out its inspections more effectively.

It is important to emphasize that the STPS, through the Decent Work Unit, can deny or cancel the registration of those who do not comply with the provisions of the LFT.

It is also important to comment that those who are operating from the beginning within the provisions of the LFT should not worry about the Amendment. What is recommended is to make available to the authority all the documents with which the companies prove due compliance with the provisions of the LFT on the matter, since the verification inspections by the STPS will continue.
