The Regulation of the Federal Attorney for the Defense of Workers is issued

On August 31, 2022, the Resolution issuing the Regulations of the Federal Attorney for the Defense of Workers (the Regulations) was published in the Federal Official Gazette (DOF).

The purpose of the Regulations is to establish the organization and operation of the Federal Attorney for the Defense of Workers (PROFEDET), as well as to determine its organization, attributions and powers.

The PROFEDET, as a labor authority, is a decentralized administrative body with technical and administrative autonomy from the Ministry of Labor and Social Welfare (STPS), which is responsible for exercising the powers and capabilities conferred on it at the federal level, the Federal Labor Law, the Internal Regulations of the STPS, and the Regulations.

The PROFEDET has the following main powers: (i) guide, advise and assist workers and unions that require it; (ii) help the Labor Conciliation Centers, to guide workers; (iii) collaborate with the interested parties to obtain solutions in favor of the workers; among others.

The Regulations entered into force on September 1, 2022. The PROFEDET Regulation published in the DOF on October 29, 2014 is repealed, however, the current administrative provisions will continue to be in force, as long as they do not oppose the Regulations.

The matters that are in process at the entry into force of the Regulations, will be attended by the administrative units until their conclusion, in accordance with the provisions in force at the time of its beginning. Therefore, special care shall be taken in matters that are still in process until they are concluded, since the provisions of the Regulations will not apply to them.
