On June 8, 2023, the NOM-037-STPS-2023. Teleworking-Safety and health conditions at work (the NOM), was published in the Federal Official Gazette.

The NOM granted a period of 180 calendar days to analyze and prepare the conditions for its entry into force. On December 5, 2023, the indicated period will expire and with this the NOM will come into force. Therefore, by that date, companies and people who are working under the teleworking scheme shall define whether they continue with the same work scheme or return to the offices, as they had been doing until before the pandemic. Let us remember that the NOM was created as a result of the COVID-19 pandemic, with the intention that operations in factories and offices would not stop their activities.

If the teleworking scheme continues, the people who continue to operate under it shall have all the necessary conditions to work from their homes. It is important to take into account what is mentioned, since it is very likely that as of December 5, 2023, the Ministry of Labor and Social Security will begin a series of labor inspections to verify compliance with what is established in the NOM.
